The Congress passed and President Biden signed the Marriage Equality Act out of concern that the Supreme Court would reach back to deny legal support for gay marriage. Should the Court do so, the action would be similar to what it did to eliminate women’s right to abortion. Then, the Court ignored established practice and Rule of Law. Now Congress has codified marriage for everyone.
